Definitions:
The Client : The company or individual employing the services of bis-zone.com.
bis-zone.com: The provider of services to the Client
General
bis-zone.com will carry out work only where a Proposal and Costs Estimate, produced by bis-zone.com, has been accepted and agreed by the Client, who must be over 18 years of age. Acceptance of a Proposal and Costs Estimate is deemed to be a written or verbal contract between bis-zone.com and the Client, this includes telephone and email agreements.
Website Design
Every effort will be made to ensure all parts of the Client's site, including scripts or programs are error-free. However, bis-zone.com will not be held responsible for any loss or damage occurring due to errors or failure or malfunction of any part of the Client's website.
The website design, graphics, content (as supplied by bis-zone.com) and programming code remain the property of bis-zone.com until paid for in full by the Client.
Any scripts or software, written by bis-zone.com, in connection with a Client site will remain the copyright of bis-zone.com, and may not be reproduced, copied or used in any other application, without the written consent of bis-zone.com. However, scripts / software, supplied to the Client in connection with development, de-bug or update work on the Client's own material, will, by prior agreement, be and remain the copyright of the Client.
Web site Content
bis-zone.com will not be responsible for the legality or copyright of material supplied by the Client, and bis-zone reserves the right to demand proof of the Client's right to use any material supplied.
bis-zone.com reserves the right to refuse to accept or handle any material which it deems illegal, indecent or dishonest.
Deadlines / Timescales
bis-zone.com will endeavour to meet mutually agreed deadlines, but will not be held responsible for any costs incurred due to missed deadlines, and in particular for deadlines missed due to :
Client failure or delay in providing material;
Client failure or delay in approving work at set stages;
Client request items additional to the original brief / proposal / costs estimate.
Any additions to the original brief / proposal / costs estimat will need to be agreed, between bis-zone.com and the Client, taking into account feasibility, extended timescales and additional costs.
Disputes/ Hosting / Testing
bis-zone.com will not be liable for, or become involved in, any disputes arising between the Client and its customers, even if those disputes arise in part or whole from use of the Web site. Client's sign off of the site, prior to launch, will be deemed acceptance, by the Client, of the site, its performance, and all its functionality.
bis-zone.com will not be liable for any problems or costs incurred through Hosting and Maintenance of the Client's site, as this will be carried out on external Web servers, with Terms and Conditions of service, being agreed between the Client, and the third party provider, separately from any agreement / contract with bis-zone.com This applies both to providers recommended by bis-zone, and those sourced independently by the Client.
The client is expected to test fully any application or programming relating to a site developed by bis-zone.com, prior to the site being put 'live'. An appropriate development / testing environment will generally be provided by biszone.com, the location of which will be agreed with the Client at project commencement. Where significant amounts of space are required, however, bis-zone.com may revert to the Client for the provision of appropriate environment for testing / development.
The point at which the site is live, signifies the end of the contracted development phase, with all outstanding accounts becoming due and payable at this point. If errors or 'bugs' are found after site goes live, bis-zone.com will (on a goodwill basis, and without obligation) endeavour to provide fixes for the problem(s).
Client Site Compatibility
bis-zone.com will endeavor to ensure that Client sites will perform correctly on the server for which it i s intended, and that site content and functionality will work to an acceptable level with recent versions of IE and Mozilla browsers. bis-zone.com can offer no guarantees of correct function with all browser software.
Search Engine Optimisation and Performance
Due to the nature of Internet Search Engines, no guarantees can be made of high placements within a specified time period from site launch. However, bis-zone.com does undertake to use every effort to achieve the best possible ranking, within the Client's own particular industry sector.
Invoicing and Payment
Payment schedules are agreed on an individual basis with Clients, with the over-riding proviso that all outstanding monies are paid to bis-zone.com, at the point at which the site goes live, or within a reasonable or mutually agreed period directly therafter.
